Welcome to Box-Kat!

These Terms of Service ("Terms") govern your use of www.box-kat.com (the "Site") and your purchase of products from Boxkat Rodent Barriers LLC, 20915 Happy Valley Road, Stanwood, WA 98292, United States ("Box-Kat," "we," "us," or "our").

By using or buying from our Site, you agree to these Terms and to the policies they refer to, including our Shipping Policy, Refund Policy, and Privacy Policy. If you do not agree, please do not use our Site.

1. Eligibility and General Conditions

By using or buying from our Site, you confirm that you are at least 18 years old (or the age of majority where you live) and able to agree to these Terms.

We may refuse service to anyone at any time, and we may change or discontinue any part of the Site without notice.

2. Using Our Site

You agree not to use the Site or our products for any illegal or unauthorized purpose, and not to transmit malicious code, interfere with the Site, or access it by automated means that place an unreasonable load on it.

If you break these Terms, we may suspend or end your access to the Site.

3. Products and Pricing

We work to show our products accurately, including color, size, and description, but we can't guarantee your screen displays them exactly.

All products are subject to availability. We may limit quantities or discontinue products at any time.

Prices may change without notice. The price that applies to your order is the one shown at checkout when you place it.

4. Orders and Payment

All orders are subject to our acceptance. We may refuse or cancel an order if:

(a) the product is out of stock;

(b) there is a pricing or listing error;

(c) we suspect fraud or unauthorized activity; or

(d) a discount code was used in a way these Terms don't allow.

If we cancel an order after you've paid, we will refund the full amount you paid.

Payments are processed by our payment providers, which may include Shopify Payments, PayPal, Shop Pay, and Google Pay. We do not store your full payment card details.

You agree to provide accurate billing and shipping information and are responsible for all charges on your order, including taxes, shipping, and, for Canadian orders, any duties or import fees.

5. Discount Codes

Discount codes may come from us or from one of our referral partners. Unless a specific offer says otherwise:

(a) codes must be entered by you at checkout and are not applied automatically;

(b) only one code can be used per order;

(c) codes can't be added to an order after it has been placed;

(d) codes have no cash value and can't be exchanged for cash or credit;

(e) codes may not be sold, traded, or posted on coupon or deal sites; and

(f) codes may expire, and we may change or withdraw a code at any time.

We may cancel an order, or decline to honor a code, if the code was obtained or used fraudulently or in violation of these Terms. If you return an order that used a code, your refund is based on the amount you actually paid.

6. Referral Partners

Box-Kat works with independent referral partners, such as repair shops, RV service centers, and storage facilities, who recommend our products. When you buy using a partner's discount code or referral link, that partner earns a commission from us. This does not increase your price

Referral partners are independent businesses, not employees or agents of Box-Kat. They are not authorized to make promises, guarantees, or commitments on our behalf. Your purchase is from Box-Kat, and these Terms apply to it no matter who referred you. Questions about your order should come to us.

7. Referral Partner Program

If you apply to or take part in our Referral Partner Program, your participation is governed by the Box-Kat Referral Partner Program Terms at https://www.box-kat.com/pages/partner-terms, which you accept when you apply. Where those terms and these Terms differ on partner participation, the Referral Partner Program Terms control. These Terms still apply to your use of the Site and to any purchases you make.

We may approve, decline, suspend, or end a partner's participation as described in the Referral Partner Program Terms.

8. Bulk and Business Orders

Bulk orders and orders from businesses, including referral partners, are quoted by email. Any written quote or agreement for those orders controls where it differs from these Terms.

Products bought at partner or bulk pricing may not be resold through online marketplaces (such as Amazon or eBay) without our written permission. 

9. Shipping

We ship from Stanwood, Washington, to addresses in the United States and Canada. Shipping options and rates are shown at checkout. Delivery estimates come from the carrier and are not guaranteed, and delays caused by carriers, customs, weather, or other events outside our control are not our responsibility.

Customers outside of the United States are responsible for all import fees.

10. Returns and Refunds

We accept returns within 30 days of delivery for eligible items in their original packaging, as described in our Refund Policy. Customers are responsible for return shipping, and original shipping costs are non-refundable.

Our Refund Policy governs all returns and refunds.

11. Using Your Box-Kat

Please set up and use your Box-Kat according to the instructions included with your kit and posted on our Site. Check the barrier periodically for gaps, shifting, or damage, and make sure it is fully clear of your vehicle before you drive or move it.

Box-Kat is a physical barrier designed primarily to keep house mice away from parked and stored vehicles. It is not a pest-control service and is not a substitute for addressing an existing infestation in or around your vehicle.

12. Product Performance and Warranty Disclaimer

Box-Kat products do not come with a manufacturer's warranty. Rodent activity depends on location, season, surfaces, and setup, so results vary. Specifically, we do not warrant that a Box-Kat will:

(a) keep every rodent away from your vehicle or prevent all rodent damage;

(b) perform the same against rats, squirrels, or other animals as it does against house mice;

(c) eliminate every gap on every floor or ground surface, including uneven, sloped, gravel, or dirt surfaces;

(d) perform as designed if it is set up differently from our instructions, modified, damaged, or left with gaps; or

(e) resist fading, wear, or degradation over time, including from sun, weather, or chewing.

Except as stated in these Terms, and to the fullest extent permitted by law, our products are sold without any other warranties, express or implied. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

13. Limitation of Liability

To the fullest extent permitted by law, Box-Kat and its owners, officers, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from:

(a) your use of, or inability to use, the Site or our products;

(b) rodent damage to any vehicle or other property;

(c) loss of use of a vehicle;

(d) product misuse or setup errors; or

(e) unauthorized access to your information.

In all cases, Box-Kat's total liability will not exceed the amount you paid for the product(s) in question. Some places don't allow certain limits on liability, so these limits apply only to the extent the law allows.

14. Reviews, Photos, and Other Content You Share

If you submit a review, photo, video, or other content to us or through the Site, you confirm that it is yours to share and is honest and accurate. You give Box-Kat a non-exclusive, royalty-free, perpetual right to use, display, reproduce, and lightly edit it (for example, for length or clarity, without changing its meaning) on our Site, in marketing, and on social media.

If you received a product for free or at a discount, or you are a referral partner, please say so in your review. We may remove content that is false, offensive, or unrelated to our products.

15. Intellectual Property

All content on the Site, including logos, text, product designs, graphics, photos, and videos, belongs to Boxkat Rodent Barriers LLC or its licensors and is protected by copyright and trademark laws.

You may not copy, distribute, or modify our content without our written permission. Referral partners may use the logos, photos, and materials we provide as allowed in the Referral Partner Program Terms.

16. Third-Party Services

Our Site works with third-party services, such as our store platform, payment providers, referral program platform, review platform, and analytics and advertising tools. We are not responsible for the content, policies, or practices of those third parties.

17. Personal Information

Your submission of personal information through the Site is governed by our Privacy Policy.

18. Errors, Inaccuracies, and Omissions

The Site may occasionally contain errors in product descriptions, pricing, or availability. We may correct errors, update information, and cancel affected orders at any time without notice.

19. Indemnification

You agree to indemnify and hold harmless Box-Kat and its owners, officers, employees, contractors, and suppliers from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

20. Governing Law and Disputes

These Terms and any dispute arising from them are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles.

If you have a concern, please contact us first at hello@box-kat.com so we can try to resolve it informally. If we can't resolve it within 30 days, either of us may bring the dispute in the state or federal courts located in Snohomish County, Washington, except where the law gives you the right to bring it where you live.

21. General

These Terms, together with the policies they refer to, are the entire agreement between you and Box-Kat about your use of the Site and your purchases. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of it. We are not responsible for delays or failures caused by events outside our reasonable control. You may not transfer your rights under these Terms without our consent.

22. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top shows when they last changed. Changes apply from that date forward and do not affect orders already placed. Continuing to use the Site after a change means you accept the updated Terms.
